The “caregiver”, agrees to exercise due and reasonable care to take care of the client’s cat(s) for the client, hereinafter referred to as the "owner".
The owner confirms the animal(s) has/have not been exposed to distemper or rabies within the last thirty days and that the required shots have been obtained.
The caregiver shall receive the compensation agreed in accordance with the terms of the contract.
Both parties understand that Kitty in NY Inc.'s obligation is that of a broker who solely helps you find a boarding accommodation/cat sitter for the pet(s) during the requested dates. They understand once they agree to the conditions (by signing the contract) Kitty in NY Inc. has fulfilled its obligation and from that point on the owner will look solely to the caregiver for any subsequent issue. They agree to indemnify and hold harmless Kitty in NY Inc. and its representatives/agents, with respect to a claim arising from the actual or alleged act, failure to act, error, or omission during the service.
Kitty in NY Inc. will not be responsible for the fulfillment or non-fulfillment of any promise or inducement made to the owner by the caregiver. Both parties further understand that Kitty in NY Inc. puts the owner and the caregiver in touch and shall not be responsible for any loss, injury, damage or delay arising after this contract. It should be noted that during the caregiver’s visits (cat sitting), Kitty in NY Inc. shall not be responsible for any damage, or incidents that occurred during the caregiver’s stay in the premises. Kitty in NY Inc. will refund the fee to the owner if the service should be canceled by the caregiver or if the owner decides the assigned caregiver doesn't meet the client's expectations and no other caregiver can be found to meet the owner's requirements.
If the pet(s) become(s) ill, or the caregiver suspects pet(s) is/are ill, the owner shall be notified at once, collect, if possible, or such attempt shall be made to so notify the owner, and if the owner does not immediately inform the caregiver regarding measures to be taken or if the state of the pet’s health requires quick action, the right to a veterinarian or to administer medicine or to give advisable attention within the discretion of the caregiver and such expenses being reasonable in amount shall be promptly taken in charge by the owner.
The owner grants permission to use the pet’s pictures taken of the animal during the service on social media as long as no names or personal details are shown. These pictures cannot become part of Kitty in NY Inc brand name or logo and will not be displayed in press, video, audio or print form.
Unless the owner files with the caregiver within five (5) days from the end date of the service a written demand for any claimed injury or damages resulting from the boarding/sitting of said pet(s) under this contract, said owner shall and does hereby waive any and all rights which he may have against the caregiver nor the agency for any liability arising under this contract or the services therewith, for damages, or otherwise.
The owner agrees on our extension policy: to extend the service for one extra day/visit, make arrangements with your caregiver. If you need to extend the boarding/sitting time beyond 1 extra day/visit, contact Kitty in NY Inc. to get a new contract for the extension.
So long as the caregiver follows the care instructions provided by the owner, the caregiver or Kitty in NY cannot be held responsible for the death of the animal because of incidents or health issues (known or unknown at the time of the contract signature), worsening of health conditions or change in behavior.
The caregiver agrees to be paid for the days he/she takes care of the animal (*number of visits for cat sitting). If the client returns sooner than expected or cancels his/her plans the caregiver will refund the prorated fee.
The caregiver or Kitty in NY are not responsible for performing any medical procedures if not specifically agreed upon in written form and does not take the animal to, or request any medical assistance for the animal without the explicit permission of the owner or the appointed emergency contact. If medical treatments (e.g. administering vaccinations, injections, pills and other medications) are agreed upon, they will be performed to the best knowledge and skills of the caregiver and it is acknowledged that the caregiver is not a trained veterinarian or nurse.
All medical treatments and consultations, including required boarding and transportation, must be paid in advance or directly arranged by the owner/appointed emergency contact. It should be noted that without pre-arranged financial coverage, the caregiver might not be able to undertake any further steps and cannot be held responsible for any respective effects or outcomes.
